A growing number of people are now suing the police for damages in court instead of making a complaint against the police.

It is a sad fact that there are increasingly many instances of wrongful actions taken by Police Officers. These may arise because of the increase in Police powers over the last few years. More power almost inevitably leads to more abuse of power as all too many persons have discovered.

Increasingly, some people have felt wrongly treated by either individual Police Officers or Police Authorities. There has always been a remedy of complaining to the Police about such behavior but this rarely results in satisfaction to the individual even with the advent of the IPCC, the Independent Police Complaints Commission. Increasingly people are turning to the Civil Courts for remedies when they feel that they have suffered as a result of Police Officers’ wrongful treatment.

Wrongful Treatment

Wrongful treatment can take many forms, including, but not limited to:

Police assault claims. These can vary from death in police custody or serious injury to the person down to a Police Officer wrongly putting a person in fear of being attacked.

Wrongful arrest/unlawful arrest. There are many examples in the Courts of occasions when Police Officers have exceeded their powers of arrest.

False Imprisonment. There are cases where individuals have been wrongly detained/imprisoned by Police officers for either a few minutes or far lengthier periods.

Malicious Prosecution. The Courts recognise that in certain cases a Police prosecution has been brought maliciously against an individual entitling him to claim damages.

Trespass to property or goods. Successful actions have been brought before the Courts in cases where Police officers have wrongly held onto or damaged property belonging to individuals.
