Murder
Murder charges carry some of the harshest penalties imposed by the British judicial system in cases where the accused is found guilty. If you have been falsely accused or wrongly convicted of murder, you should assemble the best possible legal team to fight your case.
It's almost always the case that privately funded criminal solicitors and barristers have better success rates in defending clients against murder charges rather than those choosing to have legal aid.
Working on a Murder case
In addition to “How we work on a case” we work with a few very select law firms who specialise in Murder cases. The selection of such firms is based upon years of experience of working within criminal law and in building up strong working relationships with those who are dedicated to achieving the best result for their clients.
The firms, which we personally select to work with, have a proven track record of success in representing the accused who face serious and complex Murder charges. We are extremely skilled in conducting a wide range of defence enquires at any stage of an investigation or court proceedings. We have extensive experience in carrying out surveillance and this expertise enables us to trace and contact potential witnesses for the defence with ease.
Our skill set combined with our associate law firms’, and the instruction of expert counsel, enables us to create the most effective legal defence team, tailored to meet the needs of an individual client and consequently achieve optimum results.
Expert witnesses can be very useful in showing that the defendant was physically or psychologically incapable of committing the crime he is accused of, or that the physical evidence at the crime scene is not as conclusive as it may seem.
It is our role to work with the legal team you choose and to attack the prosecution’s assertions about the case. We will also present the defence carefully, robustly and fearlessly to the Court.
Murder falls within the broader definition of Homicide. Homicide covers the offences of:
- Murder
- Manslaughter
- Voluntary or Involuntary
- Specific offences such as causing death by dangerous or careless driving, infanticide or corporate manslaughter
Murder is when a person of sound mind:
- Unlawfully kills
- Any human being
- Under the Queens Peace
- With an intention to kill or cause grievous bodily harm (Malice aforethought)
Intention to Kill or cause GBH
In order to be convicted of Murder the prosecution must show that when the defendant unlawfully killed the person that it was done with a “malice aforethought”. This is the element of the offence, which distinguishes murder from manslaughter. Malice aforethought means that there must be a specific intention to either kill or cause grievous bodily harm. This element of the offence is referred to by solicitors and barristers as the “mensrea” or mental element of the offence. The prosecution does not need to prove any ill will towards the victim nor any premeditation.
Over the last five years we have increasingly dealt with numerous false allegations and wrongful conviction charges of murder. Our team have unrivalled experience in all aspects of investigation relating to homicide and we have an extremely high success rate in defending these highly complexand serious charges.
